FSBO.com operates a website and marketplace where buyers and sellers can effectuate the transfer of real property using tools to list, search, offer, negotiate, and contract all the way through closing in an easy guided process ("Services"). This Privacy Notice describes how we collect, use and share your personal information and to assist you in exercising the privacy rights available to you.

  • Social Media: Public content provided on our blogs or social pages.

Information Collected Automatically or From Others

  • Automatic Data Collection: IP address, device identifiers, browser details, and location information.
  • Technologies: We use cookies, pixel tags, and local storage to track Service performance and deliver targeted advertising.
  • Third-Party Sources: Information from social networks (if used for login) or public real estate records to supplement your profile.

2. SENSITIVE PERSONAL INFORMATION (SPI)

Under 2026 privacy regulations, some information we collect is classified as Sensitive. This includes:

  • Precise geolocation (for property searches).
  • Financial account credentials or social security numbers (for transaction processing).
  • Your login credentials for our Services.

Our Commitment: We only use Sensitive Personal Information for the specific purpose of providing the Services (e.g., processing a home sale) and do not use it to infer characteristics about you.

3. HOW WE USE YOUR INFORMATION

We use your data to:

  • Provide Services: Manage accounts, process transactions, and enable user communication.
  • AI & Automated Decision-Making: We may use algorithms to suggest property matches or estimate listing values based on your preferences. You have the right to opt-out of "profiling" that results in significant legal or financial effects.

4. DISCLOSING YOUR INFORMATION

We do not "sell" your personal information for money. However, we "share" data with:

  • Other Users: Listing information shared with potential buyers.
  • Syndication Partners: Zillow, Trulia, etc., at your request.
  • Service Providers: IT, payment processors, and customer support.
  • Business Partners: Title companies and lenders with your consent.

  • FSBO Pros: Messages and communication records may be visible to connected FSBO Pros (real estate agents and loan officers) when you are connected to them.

5. YOUR CHOICES & RIGHTS

Notice of Tracking & "Do Not Track" (DNT)

Due to the nature of our real estate Services—which rely heavily on geolocation for property searches, identity verification for secure transactions, and localized market analytics—we do not respond to or honor "Do Not Track" (DNT) signals or Global Privacy Control (GPC) mechanisms. Tracking is an essential component of the FSBO.com marketplace. By continuing to use our website and Services, you acknowledge and agree that we may collect and use your information as described in this Privacy Notice. If you do not wish to be tracked, you must discontinue the use of our Services.

Your Privacy Rights

Depending on your location, you have the right to:

  1. Right to Know & Access: Request a copy of your data. You may request data collected from January 1, 2022, onwards.
  2. Right to Full Deletion: You may request that we permanently and fully delete your personal information from our systems. Upon a verified request, we will purge your data across all production databases and backups, subject only to records we are legally mandated to retain (see "Data Retention" below).
  3. Right to Correction: Fix inaccurate data.
  4. Right to Opt-Out: Stop the "sharing" of data for targeted ads or profiling.
  5. Limit Use of SPI: Direct us to limit the use of your Sensitive Personal Information.

6. DATA RETENTION

We retain your information based on the following schedule:

  • Account Information: Retained for the life of the account plus 3 years.
  • Transaction Records: Retained for 7 years to comply with financial and real estate legal obligations. Even upon a deletion request, these specific records must be maintained until the statutory period expires.
  • Marketing Data: Retained for 12 months after your last interaction.

7. SECURITY & CHILDREN

  • Security: We use industry-standard encryption, but no system is 100% secure.
  • Children: Our Services are for users aged 18+. We do not knowingly collect data from minors.
